Profit, National Responsibility and Constitutionality?

This news caught my attention last week, finally I found time to write about it.
This is about the Temporary Restraining Order issued by the Supreme Court prohibiting the Govt. thru the Department of Health from implementing the Revised Implementing Rules and Regulations (RIRR) of the Milk Code.
In a nutshell, the RIRR would have
- Promote Breastfeeding with force
- Regulate the marketing of infant formula to children up to 3 years old.
- Require milk companies to put up labels warning that their products “may” contain either “Enterobacter sakasakii” or “salmonella.” The United Nations’ Food and Agriculture Organization and the World Health Organization earlier found that “intrinsic contamination of powdered infant formula sakasakii and salmonella is a cause of illness and infection.
Because of this, the Pharmaceutical and Health Care Association of the Philippines (PHAP) filed for TRO with the Supreme Court citing the amendments as unconstitutional. The Chamber of Commerce of the United States of America also wrote a letter to the President on similar issue.
Interestingly, Nestle Philippines, supported the drive by the Philippine Govt– This is CSR in action.
