THERE IS A NEW PROPOSAL IN TOWN FOR COMPREHENSIVE IMMIGRATION REFORM:
Our immigration system is badly broken. Although our borders have become far more secure in recent years, too many people seeking illegal entry get through. We have no way to track whether the millions who enter the United States on valid visas each year leave when they are supposed to. And employers are burdened by a complicated system for verifying workers’ immigration status . . .

I’m at work, and I’m battling a huge headache. I don’t even know what to write about anymore. It’s like everything in my brain just dried up and I’m left with nothing but unintelligible sounds bouncing back and forth between my two hemispheres. And wow, that was a pretentious way of saying I’m suffering from a motherfucking writer’s block. I don’t even know why I’m attempting to put out a half-assed entry when I’m not even in the mood to churn out anything, but heck, I’ve been working on this blog for ages now and this is like the worst possible time to give up on it, right? Right?
In lieu of an actual blog entry that actually makes sense, I’ll try to get a lot of shit out of my mind by unloading it all – in a list! Yay! – in this entry. Enjoy reading through my brainfarts.
kaylupit mo o pera! Bkit ndi nmin kyang mabuhay ng wala k? Bkit kailangang my masaktan at mangulilala ng dhil syo…? Bkit k ganyan..
DOL SECRETARY SOLIS ANNOUNCES THE DEPARTMENT TO EXERCISE ITS AUTHORITY TO CERTIFY U VISAS
“On March 15, 2010 Secretary Solis announced that the Department of Labor (“DOL”) will begin exercising its authority to certify applications for U Nonimmigrant Status Visas (“U Visas”).” So, what is the big fuss, you may ask? Well, if U.S. employers take a close look at the rules and regulations . . . it means that the U.S. Department of Labor has another enforcement tool in its “bag of tricks.” The DOL can afford U Visa status to any foreign nationals that help the DOL investigate employers who are involved in Wage and Hour Violations and other Workplace Violations. Employers need to be mindful (more then ever before) that they should carefully follow all of the DOL’s rules and regulations.

OBAMA RE-ASSERTS SUPPORT FOR COMPREHENSIVE IMMIGRATION REFORM IN THE UNITED STATES:
Obama said he told the senators and the advocacy groups that “my commitment to comprehensive immigration reform is unwavering, and that I will continue to be their partner in this important effort.”
The immigration issue is an important one for Obama, who has promised to work to solve the problem. Hispanics voted heavily for Obama in the 2008 presidential election, making the difference in key states like Florida, and their votes will be critical in the November midterm elections when Obama and his fellow Democrats will be fighting to maintain control of the House and Senate.

Villa Paulina is located in the City of Calamba
Calamba City is a first class city in the province of Laguna, Philippines. Situated only 54 kilometers south of Manila, about an hour by chartered bus, Calamba City is a popular tourist destination with its hot spring resorts, most of which are located in Barangay Pansol, and the Canlubang Golf and Country Club, site of many Philippine Opens. Calamba is also an important modern industrial center in the CALABARZON region as shown by the large number of industrial parks and business estates that are located in the city. According to the latest census, it has a population of 360,281 inhabitants in 58,466 households, making it the most populated town in Laguna province, with San Pedro, Santa Rosa City, Biñan City, and San Pablo City following it as the top 5 municipalities and cities with the highest population in the province. Calamba City is also the birthplace of José Rizal, the country’s national hero
Villa Paulina is located in the Province of Laguna
Laguna is a province of the Philippines found in the CALABARZON region in Luzon. Its capital is Santa Cruz and the province is located southeast of Metro Manila, south of the province of Rizal, west of Quezon, north of Batangas and east of Cavite. Laguna almost completely surrounds Laguna de Bay, the largest lake in the country. The province got its name from the Spanish word lago, which means lake or lagoon. Laguna is notable for being the birthplace of José Rizal, the country’s national hero. Laguna is also famous among tourists for the Pagsanján Falls, the University of the Philippines campus and the hot spring resorts in Los Baños on the slopes of Mount Makiling, Pila Town Plaza, Taytay Falls, Majayjay, the wood carvings and papier mache created by the people of Paeté, the turumba of Pákil, the Seven Lakes of San Pablo City and the Hidden Valley Springs in Calauan.
Villa Paulina Resort is blessed with Natural Hot Spring coming from the mystical Mt. Makiling
A hot spring is a spring that is produced by the emergence of geothermally heated groundwater from the Earth’s crust. There are hot springs all over the earth, on every continent and even under the oceans and seas. Because heated water can hold more dissolved solids, warm and especially hot springs also often have a very high mineral content, containing everything from simple calcium to lithium, and even radium. Because of both the folklore and the claimed medical value some of these springs have, they are often popular tourist destinations, and locations for rehabilitation clinics for those with disabilities.
Villa Paulina Resort is near Mount Makiling
Mount Makiling, also rarely Mount Maquiling, is a potentially active volcano in Laguna province on the island of Luzon, Philippines. It rises to 1,090 m above mean sea level. Legends surround the mountain, many of which relate to Maria Makiling, said to be the ‘guardian fairy’ of the mountain. The contour of the mountain is said to be that of her in a reclining position. Mt. Makiling is a popular hiking destination. The two major trails begin at the UPLB College of Forestry and Brgy. San Miguel, Sto. Tomas, Batangas. The UPLB trail is more commonly used, taking 4–5 hours to reach the summit (Peak 2). However, this trail is closed as of October 2007 due to trail damage wrought by Typhoon Xangsane on September 2006. The other trail from Sto. Tomas passes by other peaks, is more difficult, and requires 6–7 hours to reach the summit. Both trails are generally established and safe, although throughout the years there have been occasional reports of fatal accidents and injuries, especially on the Sto. Tomas side. Climbers also frequently encounter leeches along the way.
Villa Paulina Resort is near Laguna Lake
Laguna de Bay is the largest lake in the Philippines and the third largest freshwater lake in Southeast Asia (in terms of surface area) after Tonle Sap in Cambodia and Lake Toba in Sumatra, Indonesia. It is on the island of Luzon between the provinces of Laguna to the south and Rizal to the north. Metro Manila lies on its western shore. Its surface area is 949 square kilometers and has an average depth of only about 2 meters. The lake is shaped like a stylised ‘W’, with two peninsulas jutting out from the northern shore. Between these peninsulas, the middle lobe fills a large volcanic caldera. Laguna de Bay drains to Manila Bay via the Pasig River. The lake is one of the primary sources of freshwater fish in the country. There is a large island in the lake, Talim Island, which is under the jurisdiction of the towns of Binangonan and Cardona in Rizal province.

ICE serves 180 audit notices to businesses in 5 states Employment records will be screened for compliance with federal law.
NEW ORLEANS – U.S. Immigration and Customs Enforcement (ICE) is issuing Notices of Inspection (NOIs) to 180 businesses in Louisiana, Mississippi, Alabama, Arkansas and Tennessee. The notices alert business owners that ICE will be inspecting their hiring records to determine whether or not they are complying with employment eligibility verification laws and regulations.
Inspections are one of the most powerful tools the federal government has to enforce employment and immigration laws. This new initiative is part of ICE’s increased focus on holding employers accountable for their hiring practices and efforts to ensure a legal workforce.
“ICE is committed to establishing a meaningful I-9 inspection program to promote compliance with the law. This effort is a first step in ICE’s long-term strategy to address and deter illegal employment,” said Raymond R. Parmer, Jr. acting special agent in charge of the ICE Office of Investigations in New Orleans.
Employers are required to complete and retain a Form I-9 for each individual they hire for employment in the United States. This form requires employers to review and record the individual’s identity
document(s) and determine whether the document(s) reasonably appear to be genuine and related to the individual.
Due to the ongoing, law enforcement sensitive nature of these audits, the names and locations of the businesses will not be released at this time.
In 2009, ICE implemented a new, comprehensive strategy to reduce the demand for illegal employment and protect employment opportunities for the nation’s lawful workforce. Under this strategy, ICE is focusing its resources on the auditing and investigation of employers suspected of cultivating illegal workplaces by knowingly employing illegal workers. The initiative being launched today is a direct result of this new strategy.

Nachman & Associates, P.C. Immigration Lawyers:
New Jersey, just like the United States as a whole, is a global marketplace for ideas, goods and services and even talent. In fact, businesses and entrepreneurs across the Garden State benefit from the migration of highly skilled foreign national workers who are in demand in competing economies around the world. Highly skilled workers allow New Jersey companies to stay competitive by bringing the best and the brightest, add value to America’s economic infrastructure and assure the future stability of U.S. financial markets. Foreign countries, recognizing the value of these workers, often write immigration laws to attract them so additional incentives are needed to bring overseas talent to New Jersey and the United States. In this exclusive interview with COMMERCE, Nachman & Associates’ Managing Attorney David Nachman discusses the value of highly skilled foreign national labor to the economy, the competition for overseas talent and the challenges posed by immigration in the post-9/11 world. The H-1B season is about to begin, why not get up to speed on H-1B nonimmigrant visa issues?

I have a severe case of “Last Song Syndrome”. The song “Balik sa Bohol” kept on playing in my mind from the first time I’ve heard it at the very scenic Loboc river up to the departure area of Tagbilaran airport. And just like the song, images of the scenic Bohol also kept on flashing in my head as I relish the moments I was there.

U.S. says IT firm underpaid H-1B workers
Labor Department seeks $1.9M in back wages and penalty payment from N.J. company
By Patrick Thibodeau
February 24, 2010 06:56 AM ET
Computerworld – The U.S. Department of Labor is alleging that a Newark, N.J., software company, Peri Software Solutions Inc., underpaid its tech workers on H-1B visas and owes some $1.45 million in back wages to 163 people. The Labor Department is also seeking to hit Peri with a $439,000 civil penalty and a two-year debarment from the H-1B program. About 20 H-1B employers are on the department’s current list of debarred organizations. Peri officials are not commenting on the action, but Labor Department spokeswoman Leni Fortson said the company is seeking an administrative hearing to challenge the finding. “Everything is contingent upon the outcome of the administrative hearing,” she said. In a statement, U.S. Secretary of Labor Hilda L. Solis said that the company’s alleged actions “demonstrate the kind of abuses that our laws are designed to prevent. “Every worker deserves to be paid for his or her work, and the Labor Department is committed to holding those companies that violate our nation’s labor laws accountable.” Specifically, Labor Department investigators contend that Peri failed to pay prevailing wages to workers hired under the H-1B program. The company also “forced employees to sign employment contracts and then sued them when contracts were broken,” said the Labor Department. Peri was approved to hire nearly 190 H-1B workers in recent years — 120 in 2007, 64 in 2008 and three in 2009, according to U.S. Citizenship and Immigration Services records. More broadly, immigration authorities have been increasing enforcement of the H-1B program and demanding more evidence to support visa applications.
